PRIVACY NOTICE
The company Desarrollos SIMCA, S.A.P.I. de C.V. and/or its controlling, subsidiary or affiliated companies under its common control (collectively referred to as "GRUPO SIMCA"), with common address at Calle 40 Diagonal, Tablaje 41391, between Avenida Temozón and Calle 71, Temozón Norte, Postal Code 97302, Mérida, Yucatán, are companies dedicated to the construction, promotion, marketing and/or sale of residential units and lots (the "Units") within real estate developments in the United Mexican States (the "Business Activities"). As a result of its Business Activities, GRUPO SIMCA collects and/or has access to the personal data indicated in section 4 of this Notice, owned by private individuals who are interested in acquiring, or have initiated the process of acquiring one or more Units (the "Personal Data"). If You have initiated or will initiate the procedures for the acquisition of the rights of use and enjoyment of a Unit (the "Transaction") and, consequently, You have provided or will provide to GRUPO SIMCA any Personal Data physically, by e-mail, or through this website, You will be considered as a "Holder" for the purposes of this Privacy Notice.
In compliance with the Law on Protection of Personal Data Held by Private Individuals (the "Law on Personal Data"), GRUPO SIMCA shall be responsible for obtaining, accessing, using, handling, exploiting, transferring, disposing, disseminating or storing (actions that jointly shall be referred to as the "Processing" for the purposes of this Notice) of the Personal Data of the Holder.
GRUPO SIMCA undertakes before the Holder to protect its Personal Data in accordance with the provisions of the Law on Personal Data and of this Notice and, consequently, except for the Authorized Transfers (as defined in numeral 7 hereof) to not transfer to any Third Party (as defined in section XVI of article 3 of the Law on Personal Data, provided that employees, shareholders, directors, managers, agents, attorneys, advisors and other representatives of GRUPO SIMCA shall not be considered "third parties") the Personal Data of the Holder [including Financial Data and Sensitive Data (as these terms are defined respectively in sections 4.1.1 and 4.1.2 of this Notice)] without the prior consent of the Holder. In addition, GRUPO SIMCA undertakes that in the Processing of Personal Data of the Holder it shall observe the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility.
The Personal Data the Holder has revealed or will reveal to GRUPO SIMCA due to the Transaction shall include, but in no case be limited to, the following:
